Terms of Use for Subscriptin

1. Acceptance of Terms

Welcome to Subscriptin (the "App," "Service," "we," "our," or "us"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Subscriptin (individual developer) governing your access to and use of the Subscriptin mobile application.

By creating an account, downloading, installing, or using Subscriptin, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use Subscriptin. If you are under 18 (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian and that they have agreed to these Terms on your behalf.

For EU/EEA Users: If you are under 16 years old, you must have parental or guardian consent to use this App.

2.2 Account Authority

By creating an account, you represent and warrant that:

• You have the legal capacity to enter into these Terms
• All information you provide is accurate, current, and complete
• You will maintain the accuracy of such information
• You will comply with all applicable laws and regulations

3. Description of Service

3.1 What Subscriptin Does

Subscriptin is a personal subscription tracking and management application available in both free and paid tiers that allows you to:

• Track recurring subscriptions to third-party services (e.g., Netflix, Spotify, Adobe, etc.)
• Monitor subscription costs, billing dates, and payment history
• Receive notifications before subscriptions renew
• Organize subscriptions by custom categories
• View spending analytics and insights across multiple currencies
• Sync subscription data across multiple devices in real-time
• Pause, cancel, or resume subscription tracking

Important: Subscriptin is a tracking tool only. It does NOT:

• Process payments or charge your credit card
• Automatically cancel your actual subscriptions with third-party services
• Access your bank accounts or payment methods
• Manage your subscriptions on your behalf

3.2 Service Updates

Subscriptin is continuously improved and updated. The App may:

• Receive new features and enhancements
• Experience occasional bugs or errors
• Require periodic maintenance or downtime
• Change in future updates to improve functionality

You acknowledge and accept that software may contain errors and that we work to address issues as they arise.

4. Account Registration and Security

4.1 Account Creation

To use Subscriptin, you must create an account by providing:

• A valid email address
• A secure password

You may also sign in using passwordless authentication (magic link) via email.

4.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your email address remains valid and accessible

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Multiple Accounts

You may create multiple accounts, but each account must use a unique email address. Account sharing is not permitted.

4.4 Account Verification

Upon registration, we will send a verification email to confirm your email address. You may need to verify your email before accessing certain features.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use Subscriptin solely for personal, non-commercial purposes to track your own subscriptions.

5.2 Prohibited Uses

You agree NOT to:

General Prohibitions

• Use the App for any unlawful purpose or in violation of these Terms
• Violate any applicable local, state, national, or international law
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the App in any manner that could disable, overburden, damage, or impair the Service

Technical Prohibitions

• Attempt to gain unauthorized access to any portion of the App, other accounts, or any systems or networks
• Use any automated means (bots, scrapers, crawlers) to access or collect data from the Service
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
• Circumvent, disable, or interfere with security-related features or features that prevent unauthorized use
• Introduce viruses, malware, or any other malicious code

Content Prohibitions

• Upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Use the subscription "notes" or "name" fields to store illegal, offensive, or inappropriate content
• Abuse the Service to store excessive or inappropriate data unrelated to subscription tracking

Commercial Prohibitions

• Use Subscriptin for any commercial purpose without our prior written consent
• Resell, rent, lease, or sublicense access to the App
• Use the App to compete with or build a competing product

Violation of this Acceptable Use Policy may result in immediate account termination without notice.

6. User Content and Data

6.1 Your Data

"User Content" means all data you enter into Subscriptin, including:

• Subscription names, amounts, currencies, billing cycles
• Payment history and notes
• Custom categories, cancellation reasons
• Website URLs and other metadata

You retain full ownership of your User Content.

6.2 License to Use Your Data

By using Subscriptin, you grant us a limited, non-exclusive, royalty-free, worldwide license to:

• Store your User Content on our servers (Supabase)
• Sync your User Content across your devices
• Process your User Content to provide the Service (e.g., currency conversion, payment calculations)
• Display your User Content to you within the App

We will NOT:

• Sell your User Content to third parties
• Use your User Content for advertising or marketing purposes
• Share your User Content with others without your consent (except as required by law or these Terms)

This license terminates when you delete your account, subject to our 30-day data retention policy (see Privacy Policy).

6.3 Data Accuracy

You are solely responsible for the accuracy and legality of your User Content. We do not verify the accuracy of subscription amounts, billing dates, or any other information you enter.

6.4 Data Backup

While we implement backup systems, you are responsible for maintaining your own backups of critical data. We recommend periodically exporting your data by syncing to multiple devices.

6.5 Prohibited Content

You may not use Subscriptin to store:

• Content that violates any third party's intellectual property, privacy, or publicity rights
• Content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Personal information of others without their consent
• Excessive unrelated data (the App is designed for subscription tracking, not general data storage)

7. Intellectual Property Rights

7.1 Subscriptin Ownership

The App, including its design, features, functionality, graphics, user interface, and underlying code, is owned by Subscriptin and protected by copyright, trademark, and other intellectual property laws.

7.2 Third-Party Components

Subscriptin incorporates third-party software components licensed under various licenses, including:

• Kotlin Multiplatform, Compose Multiplatform - Apache License 2.0
• SQLDelight - Apache License 2.0
• Supabase-kt - MIT License
• Koin, Ktor Client, kotlinx-datetime - Apache License 2.0
• Firebase SDK - Google proprietary license
• Material Color Utilities - Apache License 2.0
• Coil3 - Apache License 2.0

7.3 Trademarks

"Subscriptin" and any associated logos are trademarks or registered trademarks of Subscriptin. You may not use these trademarks without our prior written permission.

7.4 Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Distribute, sell, lease, or sublicense the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use any Subscriptin branding in a way that suggests endorsement or affiliation without permission

8. Third-Party Services and Links

8.1 Third-Party Dependencies

Subscriptin relies on the following third-party services to function:

Supabase (Backend Infrastructure)

• Purpose: Database storage, authentication, real-time synchronization
• Privacy Policy: https://supabase.com/privacy
• Impact if Unavailable: Sync will not work; offline mode will continue to function locally

Firebase Cloud Messaging (Push Notifications)

• Purpose: Deliver subscription renewal reminder notifications
• Privacy Policy: https://firebase.google.com/support/privacy
• Impact if Unavailable: Notifications will not be delivered

Frankfurter API (Exchange Rates)

• Purpose: Provide currency conversion for multi-currency subscription tracking
• Website: https://www.frankfurter.app/
• Impact if Unavailable: Exchange rates may become stale; last cached rates will be used

8.2 Third-Party Terms

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for:

• The availability, accuracy, or reliability of third-party services
• Any changes to third-party services that affect Subscriptin
• Third-party service outages or disruptions

8.3 External Links

Subscriptin may display links to third-party websites (e.g., subscription service websites via the "website URL" field). We do not endorse or control these external sites and are not responsible for their content, privacy practices, or terms of use.

Clicking external links is at your own risk.

9. Service Availability and Modifications

9.1 No Uptime Guarantee

Subscriptin is provided "as is" with no guarantee of continuous, uninterrupted, or error-free operation. We may experience downtime due to:

• Scheduled or emergency maintenance
• Third-party service outages (Supabase, Firebase, Frankfurter API)
• Technical issues or bugs
• Force majeure events

We do not guarantee any specific uptime or Service Level Agreement (SLA).

9.2 Modifications to the Service

We reserve the right to:

• Add, modify, or remove features at any time without notice
• Change the design, functionality, or user interface of the App
• Discontinue the Service entirely with or without notice
• Modify the features available in free vs. paid tiers

You acknowledge that future updates may change or remove features you currently use.

9.3 Backwards Compatibility

We do not guarantee backwards compatibility with previous versions of the App. Updates may:

• Require you to update the App to continue using it
• Change data formats or structures
• Remove support for older devices or operating systems

9.4 Experimental Features

Some features may be labeled as "experimental" or "preview." These features:

• May not work as expected
• May be changed or removed at any time
• Are provided without warranty of any kind

10. Fees and Payment

10.1 Service Tiers

Subscriptin is available in two tiers:

Free Tier:

• Basic subscription tracking features
• Access to core functionality
• No payment required

Paid Tier (Premium):

• Advanced features and enhanced functionality
• Available via in-app purchase or subscription
• Pricing displayed in the App and App Store/Play Store

10.2 Payment Terms

If you purchase a paid tier subscription:

• Payment will be charged to your App Store (iOS) or Google Play (Android) account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your device account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

10.3 Price Changes

We reserve the right to modify subscription pricing at any time. If we increase prices:

• We will provide at least 30 days' advance notice via email or in-app notification
• Existing subscribers will be notified before their next renewal
• Price changes will apply to subsequent billing cycles after notice period
• You may cancel your subscription before the price change takes effect

10.4 Refunds

Refund requests are handled by Apple App Store or Google Play Store according to their respective refund policies:

• iOS: Managed by Apple - contact Apple Support for refund requests
• Android: Managed by Google Play - contact Google Play Support for refund requests

We do not process refunds directly. Please refer to Apple's or Google's refund policies for eligibility criteria.

10.5 Free Trial

We may offer free trial periods for paid features. By activating a free trial:

• You will be charged the subscription fee when the trial period ends unless you cancel before expiration
• You must cancel at least 24 hours before the trial ends to avoid charges
• Free trials are typically limited to one per user
• We reserve the right to determine free trial eligibility

10.6 Downgrading

If you downgrade from a paid tier to the free tier:

• Access to premium features will be lost immediately or at the end of your billing period (depending on platform)
• Your data will be retained but premium-only features may become inaccessible
• No pro-rated refunds will be provided for unused time

11. Data Synchronization and Offline Mode

11.1 Real-Time Sync

Subscriptin uses Supabase real-time synchronization to keep your subscription data consistent across all your devices. Sync features include:

• Bidirectional sync (changes on any device propagate to all devices)
• Automatic conflict resolution using "Last-Write-Wins" strategy
• Offline queue for changes made while disconnected

11.2 Offline Mode

You can use Subscriptin without an internet connection. When offline:

• All data is stored locally in a SQLite database on your device
• Changes are queued and uploaded when you reconnect
• No data is lost if you remain offline

11.3 Sync Limitations

Sync may fail or experience delays due to:

• Poor network connectivity
• Third-party service outages (Supabase)
• Device battery optimization settings (which may pause background sync)
• Conflicting changes made simultaneously on multiple devices

We are not liable for data loss, corruption, or sync failures.

11.4 Disabling Sync

You may disable sync in the App settings. Disabling sync will:

• Keep your data local to your device only
• Prevent changes from uploading to the server or syncing to other devices
• Not delete data from the server (previously synced data remains)

12. Push Notifications

12.1 Notification Types

Subscriptin may send push notifications for:

• Subscription Renewal Reminders: Alerts before your subscriptions renew (configurable timing)
• Account or Security Notifications: Important updates about your account (rare)

12.2 Notification Settings

You can control notifications:

• Globally via device settings (Settings > Notifications > Subscriptin)
• Per-subscription via App settings (enable/disable reminders for individual subscriptions)
• Timing and frequency via App preferences (e.g., 3 days before renewal, at 9:00 AM)

12.3 Notification Consent

By enabling notifications, you consent to receive push notifications from Subscriptin via Firebase Cloud Messaging. You may revoke consent at any time by disabling notifications.

13. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Key Privacy Points:

• We collect email, subscription data, and device information
• We use Supabase, Firebase, and Frankfurter API as third-party processors
• We do NOT sell your data or use it for advertising
• You have rights to access, delete, and export your data
• Data is retained for 30 days after account deletion

By using Subscriptin, you agree to our Privacy Policy.

14. Disclaimers and Warranties

14.1 "AS IS" Service

SUBSCRIPTIN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability: We do not warrant that the App is suitable for your purposes
• Fitness for a Particular Purpose: We do not guarantee the App will meet your specific needs
• Non-Infringement: We do not warrant that the App does not infringe third-party rights
• Accuracy: We do not guarantee the accuracy of payment calculations, currency conversions, or billing date predictions
• Reliability: We do not guarantee error-free, uninterrupted, or secure operation
• Data Integrity: We do not guarantee your data will be preserved without corruption or loss

14.2 Accuracy Disclaimer

Subscriptin relies on:

• User-entered data: You are responsible for entering accurate subscription information
• Third-party exchange rates: Currency conversions use Frankfurter API data, which may be delayed, inaccurate, or unavailable
• Automated calculations: Billing date predictions and payment generation are automated and may contain errors

We are not responsible for financial decisions made based on information provided by Subscriptin.

14.3 No Financial Advice

Subscriptin is NOT a financial planning, budgeting, or advisory service. We do not provide:

• Investment advice
• Tax advice
• Legal advice
• Financial recommendations

You should consult a qualified professional for financial advice.

14.4 Third-Party Service Disclaimer

We do not guarantee:

• The availability or reliability of Supabase, Firebase, or Frankfurter API
• That third-party services will remain free or unchanged
• That third-party integrations will continue to work

15. Limitation of Liability

15.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBSCRIPTIN AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY:

• Direct Damages: Loss of data, revenue, or profits
• Indirect Damages: Lost business opportunities, reputational harm
• Consequential Damages: Costs of substitute services
• Incidental Damages: Inconvenience or wasted time
• Special or Punitive Damages: Exemplary damages

This limitation applies even if we have been advised of the possibility of such damages.

15.2 Scope of Limitation

This limitation of liability applies to claims arising from:

• Use or inability to use the App
• Data loss, corruption, or unauthorized access
• Sync failures or conflicts
• Third-party service outages
• Inaccurate calculations or information
• Account suspension or termination
• Bugs, errors, or security vulnerabilities

15.3 Maximum Liability Cap

In jurisdictions that do not allow exclusion of liability, our total liability to you for all claims arising from your use of Subscriptin shall not exceed $50 USD or the amount you paid us in the past 12 months (whichever is greater).

15.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you, and our liability will be limited to the greatest extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Subscriptin, its developer, and any third-party service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your User Content or any content you submit
• Your infringement of any third-party rights (intellectual property, privacy, publicity, etc.)
• Any unauthorized access to your account resulting from your failure to protect your credentials

This indemnification obligation survives termination of these Terms.

17. Account Termination and Suspension

17.1 Termination by You

You may terminate your account at any time by:

1. Opening the App
2. Navigating to Settings > Account
3. Selecting "Delete Account"
4. Confirming deletion

Upon termination:

• Your account is immediately deactivated
• You can no longer log in or access your data
• Your data is retained for 30 days (see Privacy Policy)
• After 30 days, all your data is permanently deleted from our servers
• Local data on your device remains until you uninstall the App
• Active paid subscriptions will continue until the end of the current billing period (no refunds)

17.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:

• You violate these Terms
• You engage in prohibited uses (see Section 5)
• You provide false, inaccurate, or misleading information
• We are required to do so by law or court order
• We discontinue the Service entirely

17.3 Effect of Termination

Upon termination by either party:

• Your license to use the App immediately terminates
• You must cease all use of the App
• You will lose access to your account and User Content
• Active paid subscriptions may be cancelled without refund if termination is due to Terms violation
• Sections 6 (User Content license), 7 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), and 19 (Dispute Resolution) survive termination

17.4 Refunds Upon Termination

• Voluntary Termination: No refunds for unused subscription time
• Termination for Cause: No refunds if we terminate your account for violating these Terms
• Platform Refunds: Refund requests must be made through Apple App Store or Google Play Store

18. Changes to These Terms

18.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make changes:

• Material Changes: We will notify you via email or in-app notification at least 30 days before the changes take effect
• Non-Material Changes: We will update the "Last Updated" date at the top of these Terms

18.2 Your Acceptance

Your continued use of Subscriptin after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must:

• Stop using the App
• Delete your account

18.3 Reviewing Updates

We encourage you to review these Terms periodically. The current version is always available within the App.

19. Dispute Resolution

19.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at support@subscriptin.com and attempt to resolve the dispute informally. We will work with you in good faith to resolve the issue within 30 days.

19.2 Governing Law

These Terms are governed by and construed in accordance with:

• GDPR (for EU/EEA users): European Union data protection law
• CCPA (for California users): California state law
• Privacy Act 1988 (for Australian users): Australian federal law
• General Users: The laws of the jurisdiction where the individual developer operates

19.3 Jurisdiction

Any disputes arising from these Terms or your use of Subscriptin shall be subject to the exclusive jurisdiction of the courts in the developer's jurisdiction, except where prohibited by law.

19.4 Arbitration (Optional)

For users in jurisdictions requiring or permitting arbitration:

• Disputes may be resolved through binding arbitration
• Arbitration will be conducted in accordance with the rules of a mutually agreed arbitration service
• You waive your right to a jury trial
• You waive your right to participate in a class action lawsuit

This arbitration clause does not apply if prohibited by law in your jurisdiction.

19.5 Class Action Waiver

To the extent permitted by law, you agree to bring disputes on an individual basis only, and not as a plaintiff or class member in any class, consolidated, or representative action.

20. General Provisions

20.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Subscriptin regarding your use of the App and supersede all prior agreements, understandings, or representations.

20.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

20.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

20.4 Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign these Terms to any third party without your consent in connection with a merger, acquisition, or sale of assets.

20.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God (earthquakes, floods, fires)
• War, terrorism, or civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Third-party service outages (Supabase, Firebase, etc.)
• Pandemics or public health emergencies

20.6 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

20.7 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

20.8 Survival

Provisions that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive termination of these Terms.

22. Automatic Payment Processing Disclaimer

Subscriptin includes a feature called "Automatic Payment Processing" which:

• Automatically generates payment records based on your subscription billing cycles
• Does NOT process actual financial transactions
• Does NOT access your bank account, credit card, or payment methods
• Does NOT charge you any fees

This feature is purely for tracking purposes to help you monitor your subscription payment history. You are still responsible for paying your actual subscriptions through the respective third-party services (Netflix, Spotify, etc.).

Subscriptin does not cancel, modify, or manage your real subscriptions with third-party providers.
